Contracts with Carwashes
I need a little help in the legal department. I have been repairing windshields for over 7 years now and 95% of my business is fleets. The economy has taken a toll on the fleet business because they are only doing what they have to do and no more. I do a little retail work and that business comes from the internet yellow pages (fee ad). I've been talking to the owner of a local carwash who is open to wsr but wants me to make up a contract. Does anyone have a copy of a contract that I can use or know where I can go to get one. Any advice would be appreciated!

Safest bet would be to contact a local attorney. Just to be sure that the contract is tight, especially if it deals with permissions and money.
Having a small contract like that drawn up would be relatively inexpensive, and in my humble opinion, worth the money if it is for your business--better safe than sorry when it comes down to money.
Regards,
Adam

Re: Contracts with Carwashes
Funny, we have 200+ fleet customers, some with real big fleets, and we have never ever needed any contract.
If I may give you one very basical advice; seek help if things go beyond your own logical knowledge.
Also; do NOT sign anything if the other party wants to bring in any fee related to a fixed period, say 6 or 12 months.
You should always have an easy opt-out. Since this is all new to you and this new partner (the car wash owner/operator) you want to exit when this all new thing is not going to work the way you believed it would, therefore you should have an exit option at no cost.
I have seen too many times that things went very nasty after some time, and that there was nothing agreed on terminating the agreement.
Also; try to get exclusivity. It will require time and hard labour to get your name out there. Let's imagine you're going to be very succesfull (why not) creating a lot of traffic and business (for both), and you have to give up the location, for whatever reason, it is easy for the car wash owner/operator to get his own kit or find another wsr vendor -replacing you.
Remember; in situations like this you are not only making money yourself, but you are also adding value to the car wash. That's fine, as long as the car wash owner/operator is not going to work against you. It really should be a win-win event.

Re: Contracts with Carwashes
Thanks everyone for the input. I got a simple contract off the web that covers both the carwash and myself in a simple easy to understand format. This carwash is more interested in keeping his good name and doesn't want someone he doesn't know screwing it up. Again, I appreciate your input.
