i have a local glass company posting my torn up business cards on his front door and offering a free rock chip repair for anyone who brings it in. he also posted a consumer notice saying that insurance companies don't want to pay for mobile work. do any of you have any ideas how i can put a muzzel on him?

Not sure about your personal issue, but if it is slanderous/defamation of character you might have some recourse. As for posting that memo well that might be considered false advertising but also might be a play on words and within the boundaries. Most insurance companies will pay for a repair but they do not mention anything about how the repair gets done (Mobile or Shop).

What would make someone single you out and do that?

you can either stoop to his level, or rise above it. Here is what I would probably do:

Write him a letter saying that someone (implying an unknown third party) is doing this to you, claiming that he (your competitor) is behind it, and that you find it hard to believe that someone with his integrity would do such a thing, and that you would like to meet with him at a convenient time to discuss a strategy to try to overcome the damage that this unknown third party is trying to do to you both.

Now you have graciously given him a way out of the mess that he has created for himself. If he responds negatively... do the best you can to educate people to the truth about the insurance/mobile service issue without mentioning him or his unethical practices. The general public are not fooled for long by people like that. In fact, most sensible people will avoid him like the plague.

Remember ... "The more dirt a person throws, the more ground he loses" . Whenever anyone mentions him, just say you would rather talk about something positive, and change the subject. There is nothing more frustrating to a mean-spirited person than someone who refuses to contend with him.

Personally, I would write letter, send it certified with photos attached of his front door displaying your business cards. Instructing him to cease and desisst immediatly or.. face criminal charges in the court. You can find enough ammo oline from various Ins. Co.'s to provide proof that they do indeed prefer mobile service to thier clients. It saves thier clients time off from work etc. Send him the proof with the letter, if that doesn't work file a harrassment suit against him. You can file in small claims and file for up to $5000. of potentially lost business. As for meeting with him, take a third party non biased witness or record the conversation, just in case you need proof of you trying to settle any problems that may be. And, I would run an ad in the papers, with the heading.. "What glass shops don't want you to know:" State the obvious, most dings can be repaired, most deductibles are waived, and most people prefer mobile service.. And the average cost of a replacement is $260. vs: a $55. repair..

Your competition is actually advertising your business. Where are people getting you cards? If you have them placed around put a small sign up next to them simply stating "you get what you pay for".

Sell your cards for twenty bucks apiece

You must really be doing well to have threatened him enough to go to these lengths. His tactics are really bush league and people will see this.

...you could get a bunch of friends relatives, and maybe even a wholesaler or two, with rock chips, give them each a card, and flood this guy with a bunch of "free" repairs. When he has had enough, have people threaten to sue, untill he has to take out another add stating he no longer does this. Just a thought. Sounds like just ignoring this guy won't work

His "free" rock chip repairs are probably only for those with qualifying insurance and you can offer the same kind of "free" windshield repair. Ignore him.
