Hello. I just recently purchased a Delta kit and while I have not done any paid jobs yet, I am happy with the quality and the personal service I have received so far. Before going out, I did register the business name, purchase liability insurance and will register the business as an LLC. While most of you would not do this let me tell you why you should. I am a retired police Captain of 30 years here in NJ. Currently, I am a Constable for the Superior Court, State of NJ. In other words, I collect monies due from judgments when people or businesses are sued I have over 8,000 cases. Since the state does not pay us, we work on commission. In other words we are unlike collection companies. We have the power to freeze your bank account, seize your property i.e. work tools, vehicles and anything personal or business related to sell at public auction to satisfy the judgment. We handle suits up to $15,000 and collect 10% commission as our payment. There is no escaping us, we will find money and collect judgments and even seize vehicles and put liens on homes to collect. Now, in the 5 years I have had this business (it has been privatized), I have only seen one WSR person sued and he won the case. Now being in the business myself I would like to share this with you since I have received many tips on WSR repairs etc. (I am on your side now).
He won his case due to the fact that every time he did a repair he had a disclaimer as posted here in the forum basic saying " the window is already broken and we are trying to stop further damage." He also takes before and after pictures of all his repairs and attaches them to the customer

Forgot to mention, you can form an LLC on your own. Save up to $2,000 or whatever doing it yourself. Just go to Staples and get their software in forming an LLC, most states will only charge you around $100 to do this. You can if you have Quicken 2004 find information and links in doing the same thing and costs of an LLC right there. It is worth the time in doing this rather then put up with the hassle of these morons suing you, and beleive me they will sue in small claims court for everything including commission on top of the inital jugement, milage, interest. etc. For an example a $400 windshield will cost you in the long run an additional $40 towards the officers commission, plus filing fees, plus milage. Making this a total of around $480 or more, not worth the heartache, form the LLC, besides there are good tax breaks.

Welcome to the forum. I always have a digital camera with me and not only take pics of the actual repair site, but get a good pic of the hood and any pre-existing damage that might be there.

As for Corporations, Sub S's, LLC's, etc... That same judge hitting a Sole Proprietorship for $480.00 can hit the Corporation for the same amount. Personally, I feel that good business liability insurance and good business practices can avoid the majority of "nuisance" suits, regardless of the filing status.

Barring that, I'd rather "eat" a $400.00 windshield than pay thousands to lawyers. Barring that, NO entity can take action against an automatic stay without spending time and money to properly do so, else, they can/will sufffer severe penalties under Federal Law. Just another "tool" that one keeps available and hopes to never have to use;)
